Please read these Terms of Service ("Terms") carefully before using the Response Desk website or AI receptionist service operated by Response Desk ("we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our service in any way, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to comply with these Terms. If you are using the service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

Response Desk provides an AI-powered receptionist service that answers phone calls, books appointments, captures leads, and performs related business communication tasks on behalf of subscribing businesses. The service is provided on a subscription basis with plans as described on our pricing page.

3. Subscription and Billing

  • Subscriptions are billed monthly in advance. A one-time setup fee is charged at the time of initial purchase.
  • All fees are non-refundable except as required by law or as expressly stated in these Terms.
  • We reserve the right to change pricing with 30 days' notice. Continued use of the service after a price change constitutes acceptance of the new pricing.
  • You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

4. Acceptable Use

You agree not to use Response Desk to:

  • Violate any applicable laws or regulations
  • Engage in fraudulent, deceptive, or misleading communications
  • Harass, abuse, or harm any person
  • Transmit spam, unsolicited messages, or illegal content
  • Attempt to reverse-engineer, copy, or resell the service
  • Interfere with or disrupt the integrity or performance of the service

5. Call Recording and Compliance

You are solely responsible for complying with all applicable laws regarding call recording, including obtaining any required consent from callers in your jurisdiction. Response Desk provides tools to configure disclosure messages, but it is your responsibility to ensure your use of the service complies with local, state, and federal laws such as TCPA, GDPR, and state wiretapping statutes.

6. Intellectual Property

The Response Desk platform, including its software, design, trademarks, and content, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for your internal business purposes only. You retain ownership of your business data and call content.

7. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure. AI responses may occasionally be inaccurate — you are responsible for reviewing and configuring your AI's behavior appropriately.

8. Limitation of Liability

To the maximum extent permitted by law, Response Desk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the service. Our total liability to you for any claim shall not exceed the amount you paid us in the three months preceding the claim.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or any conduct we deem harmful to the service or other users. You may terminate your account at any time by cancelling your subscription through your account settings.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the service after changes take effect constitutes your acceptance of the revised Terms.
